O-1 Visas Para Aquellos con Habilidades Extraordinarias

En las ciencias, educación, negocios o atletismo, en las artes o logros extraordinarios en la industria de películas o la industria televisiva

La visa de no inmigrante O-1 está destinada a individuos que posean alguna habilidad extraordinaria en las áreas de ciencias, arte, educación, negocios o atletismo, o quien haya demostrado logros extraordinarios en la industria del cine o la televisión y sea reconocido nacional o internacionalmente por dichos logros.

Las habilidades extraordinarias en los campos de ciencias, educación, negocios o atletismo significa poseer un nivel de experiencia tal que el candidato es parte de un pequeño porcentaje que se ha elevado a lo más alto en su área de experiencia.

Por otra parte, en el ámbito de las artes, las habilidades extraordinarias implican distinción, es decir, un alto nivel de logro en el área evidenciado por un grado de habilidad y reconocimiento sustancialmente superior al que obtienen las personas ordinarias, de manera tal que el individuo puede ser descrito como prominente, renombrado, líder o bien conocido en el medio.

Para aquellas personas que están en la industria de la televisión, el beneficiario debe demostrar grandes logros. Esto se define como un grado de habilidad y reconocimiento significativamente por encima del resto de las personas en su mismo ámbito, como puede ser el reconocimiento popular de su extraordinaria habilidad, tener un papel principal o prominente en alguna película o en televisión.

El staff de soporte que juegue un papel esencial o integral del artista o atleta que solicita la visa pudieran solicitar visas de tipo O-2. Los trabajadores con visa O-2 deben tener habilidades y experiencia esencial con el titular de la visa L-1 que no podrían ser realizadas por un trabajador estadounidense y que son imperativas para el desempeño exitoso quien obtuvo la visa L-1.

La solicitud requerirá una carta de recomendación elaborada por algún grupo o persona que tenga experiencia en la misma área que el solicitante.

Si la solicitud O-1 proviene de un individuo que se desempeña en el ámbito del cine y la televisión, dicha carta de recomendación deberá provenir de la organización o sindicato pertinente con experiencia en ese ámbito.

En caso de que el solicitante pueda demostrar que no existe un sindicato u organización regulatoria que aplique en su caso, entonces se tomará en cuenta la evidencia presentada. De manera similar, se podrá solicitar una excepción a este tipo de consulta en el caso de un extranjero que se dedique a las artes si la misma persona busca el reingreso al país para desarrollar actividades similares dentro de los siguientes dos años de que se realizó la consulta para comprobar sus habilidades.

  • Para los individuos que busquen una visa O-1 para ámbitos ajenos al cine y la televisión, la solicitud debe presentar evidencia de que el solicitante ha recibido algún reconocimiento internacional de renombre, tal como un Premio Nóbel. Además, el solicitante deberá presentar pruebas de al menos tres (3) de las siguientes opciones:
  • Haber recibido algún premio o reconocimiento nacional o internacional en el ámbito en el que dice tener extraordinaria habilidad.
  • Ser miembro de asociaciones u organizaciones relacionadas con su área de experiencia que requieran cumplir con estándares extraordinarios, a juzgar por expertos nacionales e internacionales en la materia.
  • Haber sido reconocido, de manera personal o su trabajo, por medios de comunicación y periodísticos.
  • Tener alguna contribución científica, académica o de negocios original, relevante y de impacto en el área en que se desarrolla el solicitante.
  • Haber publicado artículos en revistas especializadas en el tema en que destaca el solicitante.
  • Un salario alto o alguna otra remuneración comprobable derivada de sus contribuciones al área en que se desenvuelve.
  • Participaciones en panel o de manera individual, como juez del trabajo de otros en el mismo ámbito en el que se busca obtener la visa.
  • Ser empleado en alguna capacidad crítica o esencial de alguna organización o establecimiento de distinguida reputación; o bien
  • Otra evidencia comparable

Para aquellos que están en el ámbito del cine y la televisión, la solicitud debe incluir evidencia de que el candidato ha recibido, o ha sido nominado para, algún reconocimiento nacional o internacional en ese medio, tal como un Premio de la Academia, Emmy, Grammy o Director´s Guild Award. De manera alterna, el solicitante puede mostrar evidencia de al menos tres (3) de los siguientes casos:

  • Estelariza o está próximo a estelarizar en eventos o producciones que tengan una reputación distinguida, de acuerdo con críticos, anuncios o publicidad, contratos o representaciones.
  • Ha alcanzado reconocimiento nacional o internacional por sus logros, evidenciado en publicaciones, revistas, diarios y otras publicaciones del medio.
  • Cuenta con un récord de éxitos comerciales o aclamados por la crítica, evidenciado por indicadores de asistencia, rating, recaudación en taquilla, títulos u otros indicadores que lo demuestren.
  • Ha recibido reconocimiento significativo por sus logros por parte de organizaciones, críticos, agencias gubernamentales u otros reconocidos expertos o autoridades que se especializan en el mismo ámbito que el solicitante.
  • Un salario alto o remuneración sustancialmente mayor por sus servicios, comparado con otros en el mismo medio,  evidenciado por recibos o contratos.

Se requiere una opinión de consulta escrita por un grupo de iguales (incluyendo organizaciones de trabajo) o personas designadas por el grupo con especialidad en su área de habilidad.

Una vez que la solicitud sea aprobada por la USCIS, el beneficiario puede aplicar para obtener la visa en la Embajada de los Estados Unidos de América o en el Consulado. La visa puede ser expedida por un periodo inicial de hasta tres años. El cónyuge e hijos menores de edad pueden aplicar para obtener una visa de no inmigrante tipo O-3. Estas visas estarán sujetas al mismo período de vigencia que el beneficiario principal. Desafortunadamente, los cónyuges o hijos con visas O-3 no podrán solicitar permisos de trabajo, aunque sí podrán estudiar medio tiempo o tiempo completo.
